The purpose of a Bail Bond is to guarantee to the court that the person being released on the bail bond will make all of their required court appearances. The most frequently asked questions? It is a financial guarantee to the court that the defendant will appear on each and every court appearance. Yes the client must appear to every court appearance unless advised not to do so per attorney. Failure of the defendant to comply with the court appearances could result in warrants being issued and the bail bonds being forfeited.
Most frequently Asked Question, as the Indemnitor am I financially responsible for the bail bond, yes. As long as the person you bail out makes all of their court appearances, you will not have to pay any money in addition to the premium. If the person is simply late to court or has a valid reason for not being there, we can usually get them back into court without additional expense to you. If the person skips bail and we are not able to return that person to court, you will be required to pay the full amount of the bail. If we are able to return them to court, you will be required to reimburse us for actual expenses incurred. Collateral is money, property, etc., that you deposit with the bail bond company. The collateral is held until the bond is exonerated and the premium has been paid in full.
In the majority of situations, we do not require collateral.
Factors that may determine if collateral will be required:
- Accused person’s past arrest history
- Whether or not accused person is local
- Accused person’s past bond history
How does the bail bond process work?
A bail agent pays the full bail amount to the court in exchange for a non-refundable fee, typically 10% of the total bail, from the defendant or a co-signer.
In Florida, the cost of a bail bond is typically 10% of the total bail amount set by the court. This fee is regulated by the state and is standard across all licensed bail bond agencies. For example, if a judge sets bail at $10,000, the bail bond premium you would pay is $1,000.
This 10% fee is non-refundable, even if the charges are dropped or the case is dismissed. It’s considered the cost of the bail agent’s service in securing the defendant’s release and ensuring they appear for all court dates.
It’s important to note that Florida law prohibits bail bond agencies from charging more or less than this standard rate, although in some cases—such as for federal bonds or immigration bonds—the rates may differ.
If you’re unable to pay the full 10% upfront, many bail bond companies, including Coleman Bail Bonds, offer flexible payment plans or financing options to help ease the burden.
