What is Bail & What is a Bond?

When a person is arrested, a certain dollar amount is set that must be paid in order for them to be released while they await their criminal trial. This amount is called bail. Essentially, bail acts as a form of insurance that guarantees the defendant will return to complete their criminal case. Without it, defendants would have to remain in jail for extended periods of time, which could lead to lost jobs and other serious consequences. However, posting bail can often be difficult because it must be paid in full to the court, and usually in cash. Fortunately, when you work with a bail bondsman in Palm Beach County, Broward County, Okeechobee County, Martin County, or Miami-Dade County, you only need to pay a small percentage of the total bail amount. From there, the bondsman handles the rest of the process on your behalf.

The Bail Process

Here’s an overview of what to expect during each step of the arrest, booking, bail, and bond process. If you have any questions, don’t hesitate to contact one of our experienced and helpful Palm beach gardens bail bondsman.

Arrest & Booking

After an arrest, the defendant will be taken to the nearest jail (or the jail in the area where the alleged crime too place), and they will be booked. The booking process includes the taking of mug shots, a criminal background check, a nationwide warrant search, fingerprinting, the confiscation of personal property, and a search for any contraband. This process takes anywhere from 4-8 hours, depending on the jail.

Bail is Set

After a defendant has been booked into jail, a bail amount will be set (either according to schedule, or by a judge at a hearing). The bail amount is determined based on the severity of the offense, as well as the defendant's criminal history (and history of skipping bail). Once bail has been set, you can work with a Palm Beach County bail bondsman immediately to begin working on getting them released and back home quickly.

Give Us a Call

At some point during the booking process, the defendant will be able to place a call. It does cost the defendant money, however (this is called a collect call). You can put money into a defendant's account, but this is often reliable. Working directly with our office is much faster, as we are setup with the jail to receive collect calls. We can work to get your friend or family member bonded out quickly once you've given us a call.

Post a Bond

When you use bail bonds in Martin County, Florida, or across teh state, you need to understand your role and responsibility as a co-signer. As a co-signer (also called indemnitor), you will be held financially responsible for the full bail amount should the defendant skip bail. If you have questions about the process and your role, don't hesitate to give us a call - we are happy to answer any questions you may have!
